Terms of Service

These Terms of Service ("Terms") govern your use of Dialect, operated by Dialect Inc. ("Dialect", "we", "us"), a Delaware corporation headquartered at 80 White Street, Floor 2, New York, NY 10013. By creating an account or using the service, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use Dialect.

Dialect is a language practice tool. It lets you have real spoken conversations in the language you are learning with a patient AI voice partner. The partner speaks naturally, understands your accent and mistakes, corrects you gently one small thing at a time, and gives you the two or three things to practice next. The goal is to help you actually speak, not just study.

Dialect is a language practice partner, not a certified course, exam, or accredited instruction. It does not award qualifications, certifications, or official language assessments of any kind. Dialect does not guarantee any outcome from your use of the service.

Dialect is not legal advice, financial advice, or any other form of professional advice. Nothing it produces constitutes a professional opinion or a recommendation to take any specific action.

You must be at least 13 years old to create an account. If you are under 18, you represent that a parent or legal guardian has agreed to these Terms on your behalf.

You are responsible for keeping your login credentials secure. You must provide accurate information when you sign up and keep it current. You may not create an account on behalf of another person without their consent.

We may suspend or terminate an account that violates these Terms, with reasonable notice where practicable.

Dialect offers three plans, all priced in US dollars:

• Free: one short spoken conversation per day. No credit card required.
• Speaker: $11.00 per month (or $110.00 per year, billed once). Unlimited conversations, every level, and saved progress.
• Fluent: $22.00 per month (or $220.00 per year, billed once). Everything in Speaker, plus multiple languages at the same time, custom topics, and priority voices.

Annual plans bill at ten months, giving you two months free. Prices are shown in US dollars at checkout and on the Pricing page.

Paid subscriptions renew automatically at the end of each billing period unless you cancel. You may cancel at any time from Settings. Cancellation takes effect at the end of the current period; you are not charged for the next period after cancellation.

We do not offer refunds for partial billing periods, except where required by applicable law. If you believe a charge was made in error, contact us at support@trydialect.com and we will review it promptly.

We may change prices with reasonable advance notice. If a price increase applies to your plan, we will notify you before the next renewal and you may cancel if you do not wish to continue at the new price.

You may use Dialect only for lawful purposes and in accordance with these Terms. You agree not to:

• Use Dialect to generate or practice content designed to harass, threaten, or harm another person.
• Use Dialect to generate or practice fraudulent, deceptive, or illegal content.
• Attempt to reverse engineer, scrape, extract, or reproduce Dialect's AI models, prompts, or underlying systems.
• Introduce malicious code, perform denial-of-service attacks, or attempt to gain unauthorized access to Dialect's systems.
• Share your account credentials or allow another person to use your account.
• Misrepresent your identity or impersonate any person or entity.

We reserve the right to terminate accounts that violate these restrictions.

You own the content you bring to Dialect, including any conversation transcripts and practice reports generated from your sessions. We do not claim ownership over your content.

You grant Dialect a limited license to store, process, and display your content solely to provide the service to you. We do not use your individual conversation transcripts to train AI models or to share with other users.

You can export or permanently delete your content from Settings at any time.

Dialect and its content, software, design, and branding are owned by Dialect Inc. or its licensors and are protected by copyright, trademark, and other applicable laws. You may not copy, distribute, or create derivative works from Dialect's content, design, or systems without our written permission.

Nothing in these Terms grants you any right to use the Dialect name, logo, or trademarks.

Dialect is provided "as is" and "as available". To the maximum extent permitted by law, Dialect Inc. disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that Dialect will be uninterrupted, error-free, or that any practice report will improve your performance in the language you are learning. Language learning outcomes depend on many factors outside our control, and Dialect makes no guarantee of results.

Dialect is not a substitute for certified language instruction, formal examination preparation, or any other professional language service.

To the maximum extent permitted by law, Dialect Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, even if we were advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of Dialect will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose or (b) $100 USD.

Some jurisdictions do not allow certain liability exclusions or caps, so some of the above may not apply to you.

You may stop using Dialect and close your account at any time from Settings.

We may suspend or terminate your access if you violate these Terms, with notice where practicable. We may also terminate the service itself, in which case we will give you reasonable advance notice and the ability to export your data.

On termination, your right to use Dialect ends. Sections on intellectual property, disclaimers, liability, and governing law survive termination.

These Terms are governed by the laws of the State of Delaware and the federal laws of the United States, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in Delaware or New York County, New York, and you consent to personal jurisdiction there.

Before bringing any formal claim, please contact us at legal@trydialect.com and give us a reasonable opportunity to resolve the issue informally.

We may update these Terms from time to time. We will notify you by email and by posting the updated Terms with a new effective date. If the changes are material, we will give you reasonable notice before they take effect. Continued use of Dialect after the update means you accept the revised Terms.
